Terms and Conditions

Article 1 - General

This agreement applies to all services we, Figy B.V. (Figy), provide to you. By using our services, you agree to these terms and conditions. Because our service can change rapidly, these terms and conditions may also change. The most recent terms and conditions always apply.

Figy is located at Capucijnenstraat 21 C-15, Maastricht. Our website is https://www.figy.app.

Article 2 - Service

Our service allows you to model your financial situation through the Figy platform. The content of our service may change over time. Detailed (and current) information about our services can be found here (and that information is part of these terms and conditions). We charge a fee for access to our service.

We reserve the right to remove functionality or data, and you cannot derive any rights from this. We may also terminate the service if you violate these terms and conditions or applicable regulations.

To get the most out of Figy, you need our app. Some of our services are also available through the website.

Article 3 - Subscription

You can use our service by subscribing. You create an account through one of our apps.

By using our app, you enter into an agreement with us (subscription). The duration of the subscription (subscription period) is agreed upon during the registration process. The subscription starts on the date agreed upon during the registration procedure (start date).

Figy sells subscriptions for a longer period, such as a (half)yearly subscription. These subscriptions cannot be terminated prematurely. You can cancel your subscription through the app.

After the subscription period expires, the subscription is automatically renewed, each time for the same period as the previous extension period.

Article 4 - Right of Withdrawal

After signing up for your Figy subscription, you have 14 days to cancel your subscription. Since the trial period of your subscription is free, you owe us nothing during the trial period, but you are also not entitled to a refund.

Article 5 - Cancellation

You can cancel your subscription before the end of the subscription period through the app's settings. The contract will then end on the end date of the subscription period and will not be automatically renewed afterward. During this period, you will still have access to Figy.

Article 6 - Price

The price for our service includes expenses and VAT. We are allowed to adjust our prices and rates at any time. The price change takes effect 7 days after the announcement.

Price changes for an existing subscription are not implemented during the subscription period. During the subscription period, you will continue to pay the initially agreed price. Price changes come into effect upon (automatic) renewal of your subscription.

Article 7 - Payment and Collection Costs

To use our app, you must provide us with a valid payment method. We will debit the amount for using the app through your payment method around the day your subscription starts.

If you fail to meet your payment obligation on time, you will automatically be in default. Your account will be deactivated until you fulfill your payment obligation again.

Article 8 - Privacy

We treat personal data confidentially. You can read more about this in our privacy statement. For additional questions, contact us at info@figy.app.

Article 9 - Use of Figy

To use our software, you must register through our app. All individuals with a personal account must keep their account details and password strictly confidential. You are responsible for all actions taken after logging in with the account details and password. You are not liable for these actions if you have timely informed us that someone else knows the password of a personal account.

You are solely responsible for the technical operation and maintenance of your internet connection, internal network, and all other components required according to our system requirements for using the solution.

We have the right to block a personal account. We do this if we have reasonable grounds to suspect that one or more of your personal accounts are in violation of the law or this agreement. In addition, we reserve the right to attach other consequences to this use.

Article 10 – Availability and Maintenance of Figy

We will ensure that you can use the Software during the time we have a contract with you. We will do our best to make the Software available 24 hours a day, 7 days a week. We are responsible for the operation and maintenance of the Software.

We may (partially) close the software for maintenance. We generally perform maintenance in the evening (00:00 - 06:00 hours).

We reserve the right to change the Software and to change, remove, or add certain features or functionalities of the Software.

We do not guarantee that the Software will be error-free. Please inform us if the software has a malfunction, such as an error message, incorrect results, or the loss of software functionality. You can do this by emailing info@figy.app. We will do our best to resolve the issue as soon as possible.

Article 11 - Third Parties

We reserve the right to have work (partially) carried out by third parties if we believe this is desirable for our business operations.

Article 12 - Liability

Figy is not liable for any damage or other adverse consequences resulting from the use or unavailability of (information on) our Website and/or Apps.

You indemnify us against all claims from third parties due to the data you have stored, collected, or processed using the Software. We are not liable for the content of the data you have stored, collected, or processed within the Software.

We are not liable for damage caused by improper use of the Software.

Article 13 – Force Majeure

We are not liable if we cannot fulfill the agreement with you due to force majeure. This also applies if you cannot fulfill the agreement due to force majeure. If force majeure lasts longer than two months, this agreement can be terminated in writing. There is no right to compensation. We will send you an invoice for:

Article 14 - Intellectual Property Rights

We (or our licensors or suppliers) are the exclusive owner of all existing and future intellectual property rights, such as copyrights, trademark rights, model rights, patent rights, source code, and know-how, related to or arising from the website and/or app.

You are granted only the right to use the website and app. You cannot claim the intellectual property rights mentioned in Article 10.1. The right to use the website and apps is non-exclusive, and it is not allowed to transfer or license the right to use the website and app. All information provided by us is for individual use only.

Article 15 - Confidentiality

We are obliged to keep all your confidential information confidential. 'Confidential information' refers to all information you have indicated as confidential or which naturally follows from the nature of the information. The following is in any case confidential information:

1) information related to research and development, trade secrets, or business information;

2) personal data as referred to in the General Data Protection Regulation (GDPR).
